Employment Law
Employment Law is the legal relationship between employee and employer, between employer and works council and between the representative bodies of employees and employers (unions, employers' federation). A whole host of detailed issues revolve around these areas concerning the reasons for, the termination and formulation of employment relationships but also materially complex procedures connected to changes of undertakings, company sales or even insolvency. We act as your adviser both in complex procedures, in particular restructuring and associated areas, as well as represent you during judicial and extra-judicial disputes.
Construction Law
Construction Law encompasses Public and Private Construction Law. In particular, Planning Permission Law and Building Regulations Law are part of Construction Law. Statutory Planning Permission Law is Federal Law and the basis of Municipal Planning Law, that is, town planning: land utilisation plans, zoning plans. Building Regulations Law is Federal State Law; the Bavarian Building Regulations govern essentially issues of safety for construction such as fire protection and construction law-related procedures for individual construction projects: planning permission, clean-up orders. Private Construction Law involves, in particular, Construction Contract Law and issues concerning warranties and compensation.
Due Diligence
In order to avoid corporate investments and purchases that result in court actions and disputes after conclusion of contract, the object of interest should be thoroughly examined in advance. We check the economic and legal condition of the company and examine the risks of existing contracts and, where necessary, legal disputes. In so doing, we work on a daily rate, deploying all requisite legal competencies and accompanying you from letter of intent to the conclusion of contract. We can also, where necessary, perform the financial check through our participation in the Ostbayerischen Mittelstandsbeteiligungs-GmbH. Corporate purchases and sales are traditionally one of the main focuses of our team.
Energy Law
Energy Law is a particularly comprehensive subject area that encompasses a variety of legal areas and individual laws that originate at the European Law level. Alongside generally known legislation concerning renewable energies, that in normal life not only concerns feed-in tariffs but, currently, frequently also issues such as heat supply and contracting, Energy Law also involves the area of Energy Management Legislation and Energy Tax Law.
Inheritance Law
For us,the main focus for Inheritance Law is in advisory services. You avoid disputes and above all it is fiscally advisable to make inheritance law-related dispositions in order to govern the unavoidable issue of legal succession. We advise you on the correct form of testament for you and your relatives with regard to civil and fiscal legislation and formulate the most practical anticipated succession, not only concerning your business. If conflicts arise between the heirs and next of kin, we handle the extra-judicial or judicial representation of our clients. Inheritance cases involving foreign legal systems, in particular, in Spanish-speaking countries, are naturally also part of our service spectrum. We recommend our clients conclude a Healthcare Power of Attorney and Advance Directive because these affect the person when he/she is still alive. Many years of experience point to the need for these arrangements to be well thought through and formulated.
European Law
The supranational federation of the European Union controls public and business daily life in many ways, with Union legislation in principle overriding national legislation. The basic liberties of European Law aim for an internal European market and directly influence our national legislature through countless regulations and directives.
Company Law
We accompany our clients' entrepreneurial commitment, from foundation to liquidation. The formulation of individual company contracts is as much a part of the tasks of a lawyer as representation in company disputes, both judicial and extra-judicial. From practical experience, the lawyer knows the contentious issues that need to be governed in the contract or in the dispute. One of the focuses of our work is corporate purchases and sales and advice during restructuring, whether related to Employment Law, Contract Law or Tax Law. In particular, we have many years of practical experience in due diligence, that is, the examination of a company you would like to invest in or purchase. Here, in association with our tax consultants, we also offer a whole spectrum of services related to accounting and the law with regard to the internal and external lives of enterprises and companies.
Intellectual Property
The protection of intellectual property is of the highest priority. Infringement of copyright or trademarks can cause enormous financial damage to the owner. Those participating in the market also need to be protected against unfair competition and restraints on trade. In this area, we can no longer do without European Competition and Antitrust Legislation.
Commercial Leasing Law
Due to its existential significance to the entrepreneur, the right to rent commercial premises has gained great importance in Business Law. The continuance of a leasing contract and the economic existence of the entrepreneur are inseparably linked to each other. Here it is important to comprehensively examine the legal background to these contracts at the negotiation and formulation stages in order to create contracts that satisfy the interests of all parties. Naturally, we also support you in court disputes with regard to issues concerning the termination of leasing contracts.
Commercial Law
Commercial Law is Mercantile Law. Whether retailer, commercial agent or also partnership or corporation - when trading, they are subject to specific statutory requirements. As the supporting pillar of our economy, medium sized companies need to carefully observe the rights and duties involved in trading with suppliers and customers.
International Legal Relations
Cross-border legal issues are on the agenda, whether international commodity trading, market entry into South America, property purchasing in Spain or simply a holiday in the Caribbean. The questions to be answered are which law is at all applicable and how justified claims can be asserted abroad. In so doing, numerous international treaties are to be taken into consideration.
Municipal Law
Municipal Constitution Law, Municipal Electoral Law and Municipal Budget and Commercial Law are also part of Municipal Law. In detail, it involves the legal basis for citizens' petitions and referenda. Using Regensburg by way of example, the sharing of responsibilities between town council and lord mayor, the choice of other mayors and speakers, the formation of committees, town council procedures, budget and town council personnel, municipal legislative enactment procedures through statutes and ordinances. Particularly noteworthy here are the annual budget statutes, fees statutes and zoning plans, also special use permits for public spaces such as through outdoor seating for pubs and inns. Also part of Municipal Law are, furthermore, all issues concerning public services such as electricity, gas and water supply, sewage treatment and refuse collection, local public transport. Further areas are culture - City Theatre - and cultural sponsoring, road and school building measures.
Tax Law
Resolving specific issues surrounding fiscal law and representing the taxpayer in opposition proceedings and tax court proceedings is traditionally the activity of a lawyer specialised in Tax Law. Also, defence during penal proceedings for tax fraud and other tax offences and also tax fraud investigation should be led by a specialist lawyer who knows the mechanisms of tax administration. We combine twenty years of experience in the field of Tax Law with cooperation with accomplished tax consultants so that comprehensive advice for our clients in all areas of Tax Law is assured. Constitutional Law
Constitutional Law encompasses State Law, Electoral Law and Parliament Law including Petition Law, the issue of the constitutionality of legislation and the examination thereof by the citizen by means of constitutional complaints, in Bavaria also through 'popular actions'. Here, basic liberties or the infringement thereof, play a special role. With submissions and complaints - petitions - anyone can address Parliament, for example the Bavarian Parliament or the German Federal Parliament, whichever is applicable. In the case of the constitutionality of legislation, it is in particular a question of conformity with basic liberties and the extent of competence: who has legislative competence, if at all - Federal Government or State Government?
Vertragsrecht, Vertragsgestaltung
Contractual relations between private individuals, companies or also public authorities are diverse and complex. The contract is the means to legal realisation of individual objectives and peculiarities in a conglomerate of specific actual circumstances and subjective ideas. With the correct contract negotiations and formulations, conflicts will be avoided and benefits will be won in advance.
Administrative Law
General Administrative Law, Administrative Procedures Law and Administrative Procedural Law are part of Administrative Law. In general, Administrative Law is about general issues, for example whether a ruling may have retrospective effect, whether an administrative act can be cancelled or withdrawn, whether the authorities acted correctly, in particular whether they used due discretion. Furthermore, it is often a case of a fair hearing, notice periods and legal remedies as well as ultimately administrative sanctions. Administrative Procedural Law governs in particular administrative court procedures including provisional legal protetcion. In particular, Administrative Law includes, among others, Road Traffic Law, Police Law, Right of Assembly, Foreign Nationals Law, Public Construction Law, Civil Service Law and Military Law.
Business Criminal Law
There are a variety of points of contact with the provisions regarding Business Criminal Law, from the foundation of a company, via its management, to its termination. We talk about Business Criminal Law when the protective purpose of normal criminal areas are transposed onto areas of business. This includes, in particular, crimes from Criminal Tax Law and Insolvency Law and also matters concerning fraud or also the theft of intellectual property. We advise and represent you here, from prevention to defence.
Economic Administrative Law
Here, Economic Administrative Law is a segment of special Administrative Law concerning affairs to do with economic dimensions of public administration. Overlap with other issues, such as Municipal Law issues, are possible and not seldom. The consitutional basis of economic life, state economic administration, self administration such as through chambers of commerce, Trade Law, Licensed Premises Law, Tradesman Law, Transport Industry Law, Public Procurement Law and Subsidy Law.
Customs Law (Foreign Trade)
We live in an era of globalisation. Whether the import of fruit from Brazil and textiles from China or the export of German machine components and weapons systems and foreign trade beyond European internal borders, strict compliance with various specific public provisions and international treaties are required. German Customs Law is European Customs Law. All member states comply with the uniform, so-called Customs Codex.
